Terms and Conditions

Agreement

These Terms and Conditions of Use ("Agreement") govern your use of MP4 to MP3 - Converter, a mobile application ("App") owned and operated by ORIOL NADAL SERRA ("Company," "we," "us," or "our"). By accessing or using the App, you agree to be bound by this Agreement, as well as our Privacy Policy, which is incorporated by reference into this Agreement. If you do not agree to these terms, do not use the App.

Licensed Application End User License Agreement

Apps made available through the App Store are licensed, not sold, to you. Your license to each App is subject to your prior acceptance of either this Licensed Application End User License Agreement ("Standard EULA"), or a custom end user license agreement between you and the Application Provider ("Custom EULA"), if one is provided.

Scope of License

Licensor grants you a nontransferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules.

Consent to Use of Data

You agree that Licensor may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services related to the Licensed Application.

Termination

This Standard EULA is effective until terminated by you or Licensor. Your rights under this Standard EULA will terminate automatically if you fail to comply with any of its terms.

External Services

The Licensed Application may enable access to third-party services and websites ("External Services"). You agree to use the External Services at your sole risk. Licensor is not responsible for the content, accuracy, or availability of such services.

No Warranty

YOUR USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.

Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE LICENSED APPLICATION. LICENSOR'S TOTAL LIABILITY TO YOU FOR DAMAGES SHALL NOT EXCEED FIFTY DOLLARS ($50.00).

Export and Legal Compliance

You may not export or re-export the Licensed Application except as authorized by U.S. law. You represent that you are not located in any embargoed country or on any restricted list.

Subscription Policy

Subscription Plans

The App may offer a subscription service that unlocks additional features and benefits to enhance the user experience. Subscription plans are available on a weekly and monthly basis and are automatically renewed unless canceled by the user.

Payment and Renewal

  • The subscription fee is charged to your iTunes account upon confirmation of purchase.
  • Subscription automatically renews unless canceled at least 24 hours before the end of the current period.
  • Renewal charges occur within 24 hours before the subscription period ends.
  • Users can manage subscription and turn off auto-renewal in their iTunes account settings.

Refund Policy

Refunds will not be issued for unused portions of the subscription period.

Apple Subscription Terms

The subscription service is managed by Apple Inc. and is subject to Apple's terms and conditions. ORIOL NADAL SERRA does not have control over the subscription process or billing system and is not responsible for any subscription-related issues.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Spain. Any dispute arising under this Agreement shall be resolved by binding arbitration in accordance with the rules of Barcelona.

Miscellaneous

This Agreement constitutes the entire agreement between you and us regarding your use of the App. If any provision is found invalid, the remaining provisions shall remain in full force. We may assign this Agreement without your consent.
